China’s new cross-border data transfer draft measure placed under the microscope

The Cyberspace Administration of China recently released new draft “Measures on Security Assessment on Cross-border Transfer of Personal Data” for public consultation. The release presents another approach to cross-border data transfer under the China Cyber Security Law. These CAC New Draft Measures superseded the previous efforts of CAC on cross-border data transfers. Fangda Partners’ Gil Zhang, CIPP/A, CIPP/E, CIPM, FIP, and Kate Yin break down the new draft measure, the alternate proposals developed by various industries and why a new cross-border data-transfer agreement will be inevitable in China.
